1. Membership Rules

  • By purchasing a membership, you accept our terms and conditions, including our waiver policy. Training cannot commence without completing a waiver.

  • Memberships are non-transferable.

  • Memberships are for over 18's only.
  • Cancellations: Monthly memberships require 10 days' notice. Prepaid term memberships are non-refundable and cannot be paused.

  • Payment is via Direct Debit or card in advance unless a prepaid term contract deal is applied.

  • Members must check in on entry; failure to do so breaches Health & Safety rules and may lead to termination.

  • The gym operates a zero-tolerance policy towards inappropriate conduct, including harassment, disruptive behaviour, attempts to reprimand staff and misuse of equipment.

  • Members must respect gym etiquette, including returning weights, limiting CV equipment use to 20 minutes during peak times, and maintaining hygiene.

  • Gym attire must be worn at all times; inappropriate clothing or sandy or dirty footwear is not permitted.

  • Smoking, vaping, and animals (except service animals) are prohibited on-site.

  • Personal training is restricted to authorised trainers who must register and pay applicable fees.

  • The gym is partially unsupervised and limited in part to office hours; members train at their own risk.

  • Social media content must not include other members without consent. Filming requires prior approval, no tripods permitted on the gym floor. Our contract is to provide gym facilities and not a studio.

  • Parking is limited to and free while using the gym only; unauthorised parking incurs a £30 daily fee.

 


 

2. Membership Terms & Payments

  • Your membership begins once accepted and payment is made.

  • You may delay your start date by up to one month.

  • The first payment includes a joining fee (if applicable). Future payments are collected monthly and are non-refundable.

  • Missed payments: Admin fees apply for failed payments. Repeated missed payments may result in suspension or termination.

  • To qualify for a monthly membership rate, a payment method must be applied to your account. Removal of payment methods breaks your agreement with us and cancels your membership.
  • We do not support or accept ad-hoc monthly payments and is in breach of our terms. Your membership will be terminated.
  • We reserve the right to adjust membership fees with one month’s notice.

 


 

3. Termination & Refunds

  • Monthly plans: Can be cancelled with 10 days' notice.

  • Upfront memberships: Are non-refundable and cannot be paused.

  • We are not obliged to provide refunds.
  • Cancellation of payment methods on your account will terminate your monthly membership.

 


 

4. Door Access & Security

  • Membership access codes are personal and must not be shared.

  • CCTV is in operation for security.

  • Guests must have a pass prepaid and check in upon arrival.

  • Unauthorised entry or code sharing will result in penalties and/ or membership termination.

 


 

5. Guest Memberships

  • Guest passes are valid only for the immediate entry and are non-transferable and non-refundable.

  • Guests must check in and agree to the waiver terms.

 


 

6. General Terms

  • Members must be 18+.

  • Rules may be updated, with notice provided.

  • We may close the gym temporarily for maintenance or emergencies without refunds.

  • We are not liable for personal belongings or vehicle damage.

  • Personal training agreements are separate from gym membership contracts.

  • This agreement is governed by English law.

GYM WAIVER AND RELEASE OF LIABILITY

1. Introduction

This waiver is a legally binding agreement between MintFit Leisure Limited (the Office Gym Club "the Gym") and the undersigned member/participant ("the Member"). By signing this agreement, the Member acknowledges and accepts all terms and conditions outlined below.

2. Assumption of Risk

The Member understands and acknowledges that participation in physical activities at the Gym involves inherent risks, including but not limited to injury, illness, incapacitation, loss of income, and even death. The Gym operates as an unattended facility, and Members participate at their own risk.

The Member agrees to:

  • Work within their own capability.
  • Use all equipment as intended and follow any provided instructions.
  • Not leave equipment unattended or in a hazardous condition.
  • Not use equipment in any manner that may cause harm to themselves or others.

3. Waiver of Liability

To the fullest extent permitted by UK law, the Member agrees to waive, release, and discharge the Gym, its owners, employees, contractors, and affiliates from any claims, liabilities, or demands arising from:

  • Any injury, loss, or damage suffered while using the gym's facilities.
  • Any injury caused by the Member’s misuse of equipment or failure to follow safety guidelines.
  • Any loss of personal property within the gym, facilities, driveway or car park.

4. Indemnification

The Member agrees to indemnify and hold harmless the Gym from any claims or actions brought against it as a result of the Member’s negligence, misuse of equipment, or failure to comply with this agreement.

5. Health & Safety

The Member confirms that they are in good health and physically able to engage in exercise. If the Member has any medical conditions, they are responsible for seeking medical advice before using the Gym.

6. Legal Compliance & Severability

Nothing in this waiver limits or excludes liability where it is unlawful to do so under UK law, including liability for death or personal injury caused by negligence. If any clause in this waiver is found to be unenforceable, the remaining clauses shall remain in full effect.

SECTION A – RULES OF MEMBERSHIP

This sets out the terms and conditions of use of the two parties, Mintfit Leisure Limited trading as the Office Gym Club (us) and the member (you)

 

    • Training waivers must be reviewed and accepted before purchasing a membership. By proceeding with a membership and using the gym, you agree to the terms of the waiver. Membership purchase automatically implies acceptance of the waiver.
    • Month-to-month memberships can be canceled with 14 days' notice. Upfront discounted term contracts are non-refundable and cannot be paused.
    • Membership fees are paid monthly via Direct Debit or card payment. If your membership ends, no refunds will be issued. Memberships are non-transferable. Exceptions for newly initiated contracts are outlined in SECTION B – MONEY BACK GUARANTEE.
    • Training cannot begin without an active contract, pass, or prepaid package. If training takes place prior to a selected membership start date or during a requested freeze period, payment terms still apply. See SECTION B – PRINCIPAL TERMS.
    • If a membership payment is missed, your membership will be considered terminated, and access to the gym will be restricted. A £20 missed payment fee applies as of October 2022. Refer to SECTION B – FEES AND CHARGES.
    • All members must check in upon entry. Failure to do so violates our door entry procedures and health and safety regulations, which may result in membership termination.
    • The Office Gym Club reserves the right to suspend or terminate memberships for rule violations or inappropriate conduct. This includes, but is not limited to, loud or offensive behaviour, harassment, impromptu group training, inappropriate language, misconduct toward staff, or actions that jeopardize the safety or well-being of others. Members are also responsible for the behaviour of any guests using guest passes.
    • Members are expected to use equipment responsibly, return free weights and other portable items to their designated areas, and adhere to time limits (e.g., 20 minutes on CV equipment during busy periods). Failure to comply may result in membership termination.
    • FREE WEIGHT AREA: Proper attire is required, and all equipment should be wiped down after use. Only bottled water or energy drinks are allowed; no glass containers. Weights must be returned to racks, and Olympic weights should not lean against walls. Dropping weights is prohibited, and collars must be used on bars and plates. Safety bars and blocks(e.g., using safety bars for solo training) must always be followed.
    • Machines should only be used for their intended purposes. Where sweaty members should wipe down equipment after use with towels or cleaning supplies provided.
    • Showers and toilets must be kept clean and ready for the next member.
    • Our facilities are for gym use only. Shower rooms are intended for occasional use after workouts, not as a substitute for personal bathroom facilities (e.g., during camping, home renovations, or van living). Misuse will result in immediate membership termination or termination of book & train passes without refund.
    • Smoking and vaping are strictly prohibited on club property, including parking areas.
    • Report any damaged or malfunctioning equipment immediately.
    • Appropriate gym attire is mandatory. Clean trainers must be worn, and workwear, boots, worn stringers, or bare chests are not allowed. Members may be charged for cleaning costs if these rules are not respected at a rate of £55 per incident
    • Allowing unauthorized access to the gym (e.g., by sharing key codes) is a serious violation and will result in membership cancellation or recovery of associated costs. Refer to SECTION B – DOOR ABUSE POLICY for details.
    • Animals are not permitted in the gym, except for qualified service animals assisting individuals with disabilities.
    • Members may not post or circulate commercial advertisements or solicit funds on gym premises.
    • Receiving unauthorized personal training or allowing external trainers to operate in the gym is prohibited. Online trainers using the gym’s facilities for their services must register and pay a £29 monthly fee. Non-compliance will result in membership termination, and any legal costs incurred from data breaches will be your responsibility.
    • The gym is not fully supervised outside office hours. Members must prioritize safety and avoid risky activities or equipment misuse. Any damages caused may result in cost recovery by MintFit Leisure Limited.
    • CCTV monitors the gym floor for security. MintFit Leisure Limited complies with IFO regulations, but these protections do not extend to unauthorized use of personal mobile cameras.
    • During unsupervised hours, inform someone if you are training alone for added safety.
    • Exercise within your physical limits and prioritize your health and safety at all times.
    • The gym is not liable for the loss or damage of personal belongings.
    • Parking is free while using the gym only. Unauthorized parking will incur a £30 daily fee unless pre-arranged. A paid car park is available on-site for extended parking needs.
    • Drinking water is available, but members must bring their own bottles. Mixing protein powders inside the gym or shower rooms is not allowed.
    • Filming or taking photos that include other members without their consent is strictly prohibited. Cameras and lighting equipment require prior approval and may involve additional fees. Social media content creation must respect other members’ privacy and safety.
    • Bullying or derogatory remarks about other members online will result in immediate membership termination. Any legal costs incurred due to such incidents will be your responsibility.
    • Filming and photography in the gym must not obstruct others or create hazards. Misuse of the facility for media purposes (e.g., treating it like a studio) may result in membership cancellation. The gym is a training facility, not a filming location.

 

SECTION B: MEMBERSHIP TERMS & CONDITIONS

PRINCIPAL TERMS

  1. Your membership agreement begins once your acceptance and payment are completed.
  2. You may delay the start date of your membership by up to one month. If you wish to begin this earlier, email us at bookthegym@gmail.com, and we’ll gladly explore your options. Please note that the Money Back Guarantee terms may apply in such cases.
  3. This agreement becomes binding once we deliver your signed membership application via email, at which point a contract will be established between us.
  4. As a member, you will gain access to all the rights and benefits associated with your chosen membership plan.
  5. Membership agreements are strictly non-transferable.

 

DIRECT DEBIT OR CARD PAYMENT FEES AND CHARGES

  1. The Joining Fee (if applicable) and your first month’s membership fee will be collected either through instant payment at purchase or by Direct Debit within approximately 5 working days of your application. Joining fees cover administrative costs tied to setting up your membership and payment agreement.
  2. If you decide to change your membership, an admin fee may apply, depending on the circumstances. This fee will always be clearly displayed in the plan details. Doing this digitally incurs no cost.
  3. Your second membership payment will be charged one month after you join. Future payments will follow monthly. Please note that all payments are non-refundable once applied to a rolling month.
  4. If a Direct Debit or card payment is declined for any reason, you will be charged a small administration fee. In cases of repeated missed payments, we may suspend or terminate your membership after providing written notice. However, we may waive a portion of the fee if the outstanding amount is settled online within 7 days.
  5. In the case of manual change or election of account, it is your responsibility to inform us if your payment or contact details change.
  6. Paying manually without a Direct Debit or Card Subscription in place will be charged at non-contract pricing from the Front Desk.

 

DIRECT DEBIT OR CARD PAYMENT PRICES

We may occasionally adjust membership prices. You will be given at least 2 weeks notice of any price changes, including the effective date and new fees. If you do not terminate your membership before the specified date, the updated price will be applied. You retain the right to terminate your membership during the notice period as outlined in these terms.

 

TERMINATION

MONTHLY DIRECT DEBIT OR CARD MEMBERSHIPS

  1. You may terminate your membership with a minimum of 10 days’ written notice. Please contact us at bookthegym@gmail.com.
  2. Your membership will remain active until the day before your next scheduled payment and will then terminate automatically.

 

PAID UPFRONT MEMBERSHIP PLANS

Paid upfront membership plans are non-refundable and cannot be paused. These plans are contracts for a set period of time.

 

CONSUMER CONTRACTS

Under the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013, you have the right to cancel your membership and receive a full refund within 10 days of starting a monthly plan. However, if you choose to activate your membership immediately, or request an early start, any refund in case of cancellation will be prorated based on the time you have used the membership.

 

DOOR ABUSE POLICY

  1. Your assigned door codes are personal to you and must not be shared. The codes remain the property of the gym.
  2. Gym access is monitored via CCTV.
  3. All members are required to check in upon entry.
  4. You may bring a guest for £9 per day or £30 per week. Payment must be completed via the membership app (booked on account) or through the online guest pass page accessible through Perk & Passes on the app . This process is monitored by CCTV, and transactions are recorded by the company. Free trials are not available, limited promotions may apply.
  5. If we suspect misuse of door codes, we may investigate. You will be notified via email and required to assist in the investigation. Following the investigation, we will contact you with our findings and proposed actions, which may include fees or cancellation of your membership.
  6. If it is determined that unauthorized access occurred, we may impose a penalty fee of £9 (guest day pass charge) plus a £20 administration fee per infraction. For repeated or severe violations, membership may be cancelled immediately, with no refund, and we may pursue costs for a locksmith reset.
  7. Should you knowingly allow unauthorized access, you may be held liable for the actions of the individuals involved and any associated damages or losses.

 

GUEST DAILY OR WEEKLY MEMBERSHIP TERMS & CONDITIONS

PRINCIPAL TERMS

  1. Guest memberships begin upon payment.
  2. Daily passes are valid until midnight on the day of purchase, while weekly or 2 week passes expire 7 days from activation.
  3. Guest members enjoy the same rights and privileges as regular members for the duration of their pass.
  4. Guest memberships are non-transferable and cannot be rescheduled to a different date.
  5. Guest memberships may be applied as partial payment toward a full membership by means of discount codes applied on a new Direct Debit only.
  6. Guest passes are non-refundable.
  7. Guests must check in using the designated iPad.
  8. All guests must register their details and agree to the waiver upon check-in.

 

SECTION C – GENERAL TERMS & CONDITIONS

MISCELLANEOUS TERMS

  1. Members must be at least 18 years old.
  2. You agree to adhere to the Rules of Membership outlined in Section A. These rules may be updated with prior notice.
  3. Failure to enforce any part of this agreement does not waive our right to enforce it in the future.
  4. We may transfer this agreement to a third party, but your rights will not be affected.
  5. Occasionally, the gym may need to close temporarily due to maintenance or emergencies. We will strive to notify you in advance and minimize disruption. Refunds will not be issued for such closures.
  6. We are not liable for delays or failures caused by events outside our control.
  7. We are not responsible for payments made to personal trainers or arrangements made with them, as personal training is a separate service.
  8. These terms do not affect your consumer rights under applicable laws.
  9. This agreement is governed by English law.
  10. We may terminate your membership immediately if you breach the Club Rules outlined in Section A.
  11. You confirm that you are in good health and capable of engaging in exercise. Please notify us immediately if your circumstances change.
